By listing your property on Hyyve, Canada’s real estate agent bidding platform, you (“Seller”, “you”, or “your”) agree to the following Terms and Conditions:
You confirm that you are legally entitled to sell the property you are listing on Hyyve, either as the owner or as an authorized legal representative.
You agree to comply with the standard listing agreement you enter into with the winning agent through the Hyyve platform.
If you execute a Buyer’s Representation Agreement through Hyyve, you agree to be bound by its terms and conditions as well.
You are under no obligation to select an agent through Hyyve. A bid is not considered accepted until you execute a listing agreement with an agent through the platform.
The upfront payment submitted by the selected agent will be held in trust by Hyyve until:
If you breach the listing agreement or any resulting agreement of purchase and sale without lawful justification, the full bid amount will be refunded to the agent, and you waive any right to claim those funds.
You acknowledge and agree that Hyyve will retain 30% of the winning agent’s bid as a platform fee. This amount will be deducted from the funds held in trust before the remainder is disbursed to you.
You agree that no interest will be earned or paid on any funds held in trust by Hyyve.
You confirm that you have lawfully completed all identity verification requirements on the Hyyve platform.
You agree to work diligently with your selected agent to market and sell your home, including allowing showings and responding in a timely manner.
You confirm that you are not using Hyyve solely to obtain upfront funds without a genuine intent to sell your home.
By using Hyyve, you agree to be legally bound by these Terms and Conditions and any future updates posted on Hyyve.ca.
You certify that all information provided—including address, property condition, disclosures, smoking status, dimensions, and images—is accurate and truthful.
These Terms and Conditions are governed by the laws of the Province of Ontario. Any disputes shall be resolved exclusively by the courts in Ontario.
By listing your property on Hyyve, you confirm that you have read, understood, and agreed to these Terms and Conditions.
